Agreement and Acceptance of Terms
This is a legal Agreement between you and Grant County Bank (the "Bank") for the use of this service (the "Service"). Either you or the Bank may terminate this Agreement. You may terminate this Agreement and your use of the Service at any time or the Bank may terminate this Agreement at any time with or without notice on your default or breach hereof.
Acceptance of Terms
If you do not agree to the terms and conditions in this Agreement, do not register for or use the Service. By completing the registration and using the Service, you signify your agreement with the terms and conditions of this Agreement. This Agreement may be updated from time to time. Upon any change, the Bank will notify you. If you continue to use the Service thereafter, your continued use of the Service constitutes acceptance of the changes and an agreement to be bound by this Agreement, as amended. If you do not agree to the changes, you agree to discontinue your use of the Service.
Description of Service
Grant County Bank provides a personal financial information management service that allows you to manage your Bank financial information.
The service allows you to view and perform transactions to your Grant County Bank accounts. Actual transaction capabilities will depend upon the type of accounts you currently have with the Bank. For an additional fee, your Grant County Bank account can be set up to allow online bill payment.
User Information
In order to activate the Service, you will need to provide Personal Information, including your name, account number and email address.
Privacy
The Bank will not sell, exchange or release your Personal Information or Account Information to any third party without your express permission, unless required by law or court or governmental order. However, the Bank may share or publicly disclose compiled, aggregated data containing no personally identifiable information, when required by law.
User Responsibilities
You agree to provide accurate and complete Personal Information to activate the Service. You agree to provide accurate and complete Account Information to utilize the Service. You agree to keep your Personal Information and Account Information up to date and accurate. You agree to protect the confidentiality of your password and your account, not to disclose your password to other parties and to notify the Bank immediately of any unauthorized use of your password or account. You agree not to use the Service to conduct any business or activity or solicit the performance of any activity, which is prohibited by law. You agree that your right to use the Service is personal to you and may not resell or make any commercial use of the Service.
Limitation of Warranties and Liability; Disclaimer of Warranties
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GRANT COUNTY BANK EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. GRANT COUNTY BANK DOES NOT WARRANTY THAT THE SERVICE WILL MEET YOUR NEEDS, OR THAT THE OPERATION WILL BE ERROR FREE OR UNINTERRUPTED, OR THAT ALL ERRORS IN PROGRAMMING WILL BE CORRECTED. NEITHER GRANT COUNTY BANK NOR ANY OF ITS UNDERLYING SERVICE PROVIDERS, INFORMATION PROVIDERS, LICENSORS, EMPLOYEES, DISTRIBUTORS OR AGENTS SHALL HAVE ANY LIABILITY FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT OR SPECIAL DAMAGES SUFFERED BY YOU OR ANY OTHER PARTY AS A RESULT OF THE OPERATION, INABILITY TO OPERATE OR MALFUNCTION OF THE SERVICE, REGARDLESS OF WHETHER OR NOT SUCH PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnification
You agree to protect and fully compensate the Bank, its affiliates and service providers from any and all third party claims, liability, damages, expenses and costs (including, but not limited to, reasonable attorneys fees) caused by or arising from your use of the Services, your violation of this Agreement or your infringement, or infringement by any other user of your account, of any intellectual property or other right of anyone.
DMCA Copyright Infringement Notice Policy
We respect the intellectual property rights of others and expect users of this website to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), we will respond promptly to notices of alleged copyright infringement that comply with applicable law.
1. Filing a DMCA Notice of Alleged Infringement
If you believe that material available on or through this website infringes your copyright, you may submit a written notification to our designated DMCA agent containing the following information:
- Identification of the Copyrighted Work
A description of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved. - Identification of the Infringing Material
A description of the allegedly infringing material and information reasonably sufficient to permit us to locate it (such as the specific URL where the material appears). - Contact Information
Your name, mailing address, telephone number, and email address. - Good-Faith Statement

Upon receipt of a valid DMCA notice, we may remove or disable access to the allegedly infringing material and notify the user who posted it.
2. Counter-Notification Procedure
If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our DMCA agent containing the following:
- Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled.
- Your name, address, telephone number, and email address.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal court located in your judicial district (or, if outside the United States, the jurisdiction where the service provider is located) and that you will accept service of process from the person who submitted the original DMCA notice.
- Your physical or electronic signature.
If we receive a valid counter-notification, we may restore the material in accordance with the provisions of the DMCA unless the original complainant files a court action seeking to restrain the allegedly infringing activity.
3. Repeat Infringer Policy
In appropriate circumstances, we may suspend or terminate the accounts of users who are repeat infringers, consistent with the requirements of the Digital Millennium Copyright Act.
4. Misrepresentations
Any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability under the DMCA.
General
This Agreement and the Service shall be governed by the laws of the State of West Virginia, without regard to its conflicts of law provisions. If any provision or provisions hereof shall be held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not be in any way affected or impaired thereby. Such unenforceable provisions shall be construed, to the extent possible, to reflect the intentions of the parties. This Agreement and any modifications published by Grant County Bank over the Service constitute the entire and only agreement between you and Grant County Bank with respect to the Service.
